Contractors and subcontractors tendering for government works should be aware of their obligations under the Western Australian Building and Construction Industry Code of Conduct 2016 (BCI Code) and Federal Code for Tendering and Performance of Building Work 2016 (Building Code 2016).
The BCI Code took effect on 1 January 2017 applies to State Government construction contracts worth more than $10 million. The Building Code commenced on 2 December 2016 and applies to all Commonwealth-funded building work. The Building Code also requires head contractors to only engage subcontractors who meet eligibility requirements.
Both codes require Workplace Relations Management Plans and Alcohol and Drug policies, including testing. Both also require contractors to demonstrate they are paying subcontractors in a reasonable and timely manner.
